Terms of Service for Hosts (Charger Owners)

Role of Zyyver: Zyyver provides an online platform and smart charging services and / or parking services connecting Hosts (EV charger owners / parking space owners) with EV drivers seeking to charge or vehicle owners seeking to park. By listing a charger and / or parking and accepting a booking, you (the Host) enter a direct contract with the EV driver or vehicle owner for use of your charging point and parking space – Zyyver is not a party to that contract. Zyyver’s role is limited to facilitating bookings, payments, and technical access (e.g. plug control); we do not own or operate your charger.

Host Obligations & Safety: As a Host, you agree to:

  • Accurate Listings: Provide complete and truthful information about your charging point and parking (location, charger type, availability, access instructions, fees, etc.). You are responsible for any misinformation and liable to the driver for losses caused by inaccurate or misleading details.
  • Charger Ownership & Permissions: Confirm that you own or have permission to share the EV charger at your premises. You must have all rights and consents needed to allow drivers on the property and to provide charger with electricity.
  • Charger and Parking Conditions & Safety: Ensure the charging equipment is properly installed, maintained, and safe to use. The charger must meet all relevant UK electrical and safety standards and also comply with UK charge point standards. The surrounding premises (driveway, cables routing, etc.) should be in a safe condition without hidden hazards. You agree to remedy any unsafe conditions and not expose drivers to unreasonable risk. As host you must ensure the parking surface is reasonably level, free of hazardous obstruction and suitable for the vehicle class you accept. You must make drivers aware of height, width or weight limits. Any hidden hazards (e.g. low walls, steep gradient) must be clearly disclosed in your listing.
  • Insurance Coverage: Maintain appropriate insurance for your liabilities. You are solely responsible for insuring your property and EV charger against damage or loss, and for carrying public liability insurance to cover injuries or property damage that might occur in connection with a charging session and / or parking session. (This may involve checking your home or business insurance and obtaining any necessary endorsements for EV charger sharing / parking.) Zyyver does not provide insurance for Hosts, and any required insurance is the Host’s responsibility. We will not be liable for breaches of obligations in your arrangement with the driver. We are acting as a market place solutions provider for peer to peer charging and parking and facilitating the transaction at an arm’s length. We strongly advise Hosts to hold adequate public‑liability cover for parking‑related risks (trip hazards, gate malfunctions) and should consult a professional for insurance needs.
  • Hosting Etiquette: Act in a neighbourly and professional manner towards EV drivers. Honour confirmed bookings by providing the charger at the booked times, and assist drivers with reasonable requests, if required (such as guidance to access the charger). Do not discriminate against users and follow all applicable laws (e.g. equality, privacy) in your interactions.
  • Compliance with Laws: Comply with all relevant laws, regulations, and codes for operating a charger and letting it out for parking. This includes electrical safety regulations, planning or local by-laws (if any), and not doing anything illegal on your property during a session. Hosts are also responsible for any required reporting or obligations (for example, if you earn income from sharing, ensuring tax compliance). Zyyver is not responsible for advising on your legal duties and tax matters. Hosts are responsible for determining whether letting a parking space requires planning permission, landlord consent, or homeowners‑association approval. Listing a space constitutes your warranty that such approvals are in place.

Licensing Use of Charger or parking: When you accept a booking, you grant the EV driver a limited license to enter your property to park and use the charging point or just for parking (without charging) for the agreed duration. This license is conditional on the driver’s compliance with your stated rules and the Terms of Service. You retain the right to access your property (e.g. in an emergency) and to enforce any agreed time limits or other reasonable house rules (such as where to park or not to block access). If a driver overstays or misuses your property, you may be entitled to charge an overstay or take lawful action to remove an unauthorised vehicle (consistent with any applicable laws and the terms herein). Any additional fees for overstays or violations must be made clear in your listing or prior to a booking being confirmed. This arrangement does not create a tenancy, security of tenure or any other property right beyond the booking window. You may revoke the licence if the driver breaches these Terms or overstays.”

Damage to Property or Equipment: If a driver causes damage to your charger or property, that is a matter between you and the driver. The driver is responsible for any damage they cause due to misuse or negligence (for example, driving into your property, or pulling the charging cable in a dangerous manner). You should report such damage to the driver and to Zyyver promptly (within 48 hours of the incident) so that we have a record. While Zyyver may assist in facilitating communication, we are not liable for repairing or compensating such damage – you should seek recovery from the driver or their insurer. Similarly, if your charger malfunctions and causes damage to the driver’s vehicle or injury, that is your responsibility as the equipment owner (assuming no misuse by the driver). Ensure your insurance covers such events; these Terms do not limit any claim a driver may have against you for a faulty charger beyond any insurance coverage. Hosts acknowledge normal wear from vehicle tyres is expected. Claims for minor scuffs, tyre marks or superficial scratches to hardstanding surfaces will not be accepted unless caused by negligence (e.g. skidding, burn‑outs).

Release & Indemnity (Host): You agree that Zyyver has no responsibility for managing your property or charger during bookings and no liability for loss or injury arising from the charging sessions, except as expressly stated in these policies. You (the Host) agree to release, defend, and indemnify Zyyver from any claims, losses, or damages (including legal costs) arising out of: (a) your breach of these Terms or of any laws; (b) your failure to have permission to rent out the charger or space; or (c) any injury or property damage suffered by the EV driver or third parties due to your acts or omissions. This means, for example, if you violate a local rule or your lease by sharing your charger and it leads to a dispute or fine against Zyyver, or if someone is injured on your property due to a hazard you failed to address, you will cover all costs and losses incurred by Zyyver as a result. This indemnity is common in similar peer platforms to ensure Hosts bear responsibility for their own spaces. Zyyver will notify you of any such claim and may allow you to handle it, but reserves the right to participate in the defense.

Terms of Service for EV Drivers (Charging Guests) or Parking Guests

Booking and Use: By booking a charge or parking on Zyyver, you (the EV driver or “Guest”) agree to pay the stated fees and comply with the Host’s specific rules for the location. Once your booking is confirmed and payment is made, you enter a direct agreement with the Host granting you a license to access the Host’s property and use the charging point for the booking period. Zyyver’s platform facilitates this transaction but Zyyver is not a party to your contract with the Host. You must only use the designated parking space and charger as agreed, within the booked timeframe. If you need to extend or alter the booking, you should arrange this through the Zyyver app (subject to Host approval and additional fees if applicable). Unauthorized overruns or early arrivals may result in extra charges or other consequences (the Host has the right to impose an overstay fee or removal and other incidental charges as per the applicable law, e.g. towing at your expense, after reasonable attempts to contact you).

Driver Responsibilities: When using a Host’s charger or parking, you agree to the following responsibilities:

  • Legal Vehicle Status: Your vehicle must be roadworthy, insured, and taxed as required by law for public road use. By using Zyyver, you confirm the EV is properly registered, you hold a valid driving licence, and the vehicle has valid MOT (if required) and insurance coverage. You will not use a vehicle declared “off-road” (SORN) or otherwise not legal to drive to attend a charging session. If you fail to meet these requirements and it causes legal issues or damage (for example, fines or impoundment), you are solely liable, and you agree to indemnify Zyyver for any resulting loss or claims.
  • Your vehicle must be mechanically sound and must not leak oil, coolant or other fluids. You are liable for the reasonable cost of cleaning or repair to any surface stained or damaged by your vehicle.
  • Safety and Proper Use: You must operate the charging process safely and follow all Host instructions and any on-screen/app guidelines for using the charger. This includes: using an appropriate charging cable if required, ensuring connections are secure, not allowing cables to create tripping hazards, and supervising the start of the session. Never attempt to use a charger that appears damaged or incompatible with your vehicle – if something looks unsafe (e.g. frayed cable, water exposure), do not proceed; inform the Host and cancel if necessary. You must not tamper with the charger or any property of the Host. Disconnect and stow any cables properly after charging. Do not exceed the agreed charging period or remain on the property beyond your booking without consent.
  • Stay Within Authorized Areas: Your booking permits you to park in the Host’s designated spot and plug into the charger. You must not access other areas of the Host’s property (e.g. entering their home, using facilities not offered, or trespassing in other parts of the premises). Remain only in the immediate vicinity of your vehicle as needed for the charging process. Respect the Host’s privacy and any house rules. While parking use only the designated bay or area indicated by the Host. Do not block access ways, doors or neighbouring spaces. Keep noise to a minimum.
  • Respect Timing and Neighborliness: Arrive and plug in on time as per your booking slot, and depart promptly once your charging session or parking period ends. Avoid noise or nuisance (e.g. loud music) while at the location. Do not block driveways or access ways. If you anticipate being late or have an emergency preventing timely return, communicate with the Host through Zyyver’s messaging if possible. Unauthorized overstays can result in additional fees or penalties as noted. A booking may be cancelled up to 24 hours before the start time for a full refund. After that, the first day’s fee is non‑refundable. Leaving early does not entitle the driver to a partial refund unless the Host chooses to re‑sell the time slot. Parking bookings are for short‑term use only.
  • Storing a vehicle (defined as leaving it for >30 days or without intent to collect) is prohibited unless expressly allowed by the Host. The Host may charge appropriately for such extended stay.
  • In casea Driver leaves the vehicle beyond the allotted time and does not extend his / her stay and also not respond to the Host for any extension beyond a reasonable lapse of time, then the vehicle may be considered as “Abandoned”. Such Abandoned vehicles may be reported to the local authority and removed at owner’s expense.
  • Reporting Issues: If you encounter any problem – for example, the charger is non-functional, you suffer any damage or injury, or there is a dispute – notify the Host immediately and inform Zyyver through the app or customer support as soon as practicable. Early communication can help resolve issues. For instance, if the charger isn’t working, the Host might resolve it or Zyyver may cancel the booking for a refund. If an accident or damage occurs on the property, cooperate with the Host in documenting it. Any damage you cause to the Host’s charger or property must be reported to both the Host and Zyyver promptly (we recommend within 48 hours).
  • Payment and Fines: You agree to pay all fees associated with your booking, including any overtime fees, parking fines (if you violated rules), or costs for damage you cause. Zyyver is authorized to charge your payment method for any such additional amounts as per these Terms. You are also responsible for any traffic violations or legal penalties incurred (e.g. if you park unlawfully or breach local regulations while on the way to or at the Host site). Zyyver and the Host have no liability for such penalties, and you must not attempt to register the Host’s address as if it were your own for any vehicle-related registrations (that could cause legal confusion). If you remain parked beyond the booked period the Host may charge an overstay fee of £10 per hour (or such other rate shown in the listing) plus any additional losses (e.g. council penalties) they incur. Zyyver is authorised to collect these fees from your payment method.
  • Cancellation: A booking may be cancelled up to 24 hours before the start time for a full refund. After that, the first day’s fee is non‑refundable. Leaving early does not entitle the driver to a partial refund unless the Host chooses to re‑sell the time slot and confirms the same.
  • When using Zyyver for parking services, users may be required to scan QR codes upon arrival/departure and may receive mobile alerts about booking expiry or potential overstays. Users agree to ensure compliance with these notifications to avoid penalties or additional charges.”

 Vehicle Damage & Theft: You understand that you are parking and charging at your own risk. Neither Zyyver nor the Host automatically insures your vehicle for damage or theft during a charging session. Hosts are not in the business of parking security, and your car remains your responsibility when parked at someone’s private property (akin to how vehicles parked are at the owner’s risk under normal legal principles). We advise that you remove or hide valuables and ensure the vehicle is locked when leaving it. In the rare event your vehicle is damaged or stolen, you should contact your auto insurer and, if appropriate, the police. If you believe the Host’s negligence (or another Zyyver user’s actions) contributed to the incident, that is a dispute to resolve with them – Zyyver is not liable for such incidents absent our own negligence. (For example, if another Zyyver driver vandalizes your car, that driver would be responsible; or if a Host’s faulty equipment causes damage, the Host may be liable to you.) Zyyver will cooperate with any law enforcement investigation as required, and we may provide available data (such as session logs) to assist, but we do not assume liability for vehicle loss or damage on-site.

Personal Injury: If you are injured during a charging session (for instance, a slip on the driveway or an electric shock), first seek any necessary medical attention. Responsibility for injuries will lie with the party at fault under applicable law. Hosts are responsible for maintaining a safe environment, and drivers are responsible for using due care; whichever party’s negligence causes harm may be legally liable. Zyyver does not supervise the physical charging sessions and generally cannot be held liable for injuries that occur unless caused by a defect in our platform or our own negligence. By using the platform, you acknowledge this risk allocation. (We strongly encourage Hosts to carry general liability and household insurance, and drivers to have adequate motor insurance that might offer some personal liability cover).

Release & Indemnity (Driver): You agree to release Zyyver from any liability for any injury, loss, or damage you may suffer in connection with a charging session, except to the extent caused by Zyyver’s breach or negligence and not lawfully excludable. To the maximum extent permitted by law, you also agree to indemnify and hold Zyyver harmless from any third-party claims or losses arising out of: (a) your own breach of these Terms or of any law; (b) your misuse of the platform or a Host’s property; or (c) your negligence or willful misconduct. This means if your actions cause harm to someone or something (including the Host or their property) and Zyyver is sued or incurs costs as a result, you will cover those costs. For example, if you overload a charger contrary to instructions and cause a fire that damages the Host’s property or a neighbor’s property, and any claim is brought against Zyyver, you must indemnify us. Likewise, if you provided false information (e.g. about your vehicle) and that leads to a dispute or legal issue that affects Zyyver, you will be responsible for our losses. Zyyver will inform you of any such claim and may allow you to handle it, provided you promptly assume responsibility in a way that protects all parties’ rights.

General Disclaimer of Platform Liability

“Marketplace” Service Only: Zyyver is a facilitator of peer-to-peer EV charging arrangements, not an owner or operator of charging sites (unless explicitly stated for certain locations) and not an agent of Hosts or Drivers in the sense of assuming legal responsibility for them. Hosts and Drivers each act on their own behalf when offering or using charging services, and Zyyver shall not be liable to either party for the performance of their contract. We help with scheduling, payment processing, and can remotely enable charging on the Host’s device, but we do not guarantee that a given Host or Driver will fulfill their obligations. Any issues with the condition of the charger, the electricity supply, the parking space, or the vehicle are fundamentally between Host and Driver (subject to any assistance or coverage we expressly provide).

ZYYVER MOBILE APPLICATION: The Zyyver mobile application is available via the Apple App Store and Google Play Store, and by using it, you agree to comply with their respective terms and conditions. You acknowledge that Apple and Google are not responsible for addressing any claims relating to your use of the Zyyver app.”

No Vetting or Warranty of Users or Content: Zyyver does not conduct exhaustive background checks on Users (Hosts or Drivers) such as criminal record screenings, nor do we verify every piece of content or listings that users provide. We may do basic identity verification or fraud checks for security, but we cannot guarantee that every user is who they claim or that a charger will be 100% as described (though misrepresentation is against our policies). All information on the platform is provided “as is” by users, and while we may moderate obvious issues, we make no warranties as to accuracy, completeness, or reliability of any listings, ratings, or user statements. For example, we do not warrant that a given charger will be compatible with your specific EV or that it will deliver a certain charging speed – it is the Host’s responsibility to describe accurately and the Driver’s responsibility to assess suitability.

Service Availability: Zyyver provides the app and services on an “as is” and “as available” basis. We strive for high uptime and proper functionality, but we do not guarantee that the platform will be uninterrupted, error-free, or meet your particular requirements at all times. Technical issues (such as network outages, software bugs, or hardware malfunctions at the charger) may occur. We will try to resolve platform technical problems as quickly as possible, but we are not liable for any loss due to service interruptions, downtime, or errors, to the extent allowed by law. We may occasionally suspend or limit the service for maintenance or security reasons, and will attempt to give advance notice when feasible. Using Zyyver’s platform is at your own risk, and you accept that the responsibility for conducting a safe charging transaction lies primarily with the Host and Driver involved.

No Guarantee of Outcome: We do not guarantee any particular outcome from using Zyyver. For Hosts, we make no promise that you will get a certain number of bookings or income. For Drivers, we do not promise that suitable chargers will always be available when or where you need them. Any expectations are speculative, and Zyyver disclaims liability for unmet expectations or lost opportunities (e.g. if you couldn’t charge when desired, or if a booking falls through). Also, while we encourage good community behavior and have a rating system, we cannot control the conduct of individual users. Use your judgment and take reasonable precautions in interacting with others (meet in daylight when possible, etc.), as you would in any peer-to-peer setting. If you have a negative experience with another user, report it – we may take action like suspension – but Zyyver is not responsible for users’ actions.

Third-Party Integrations: If our app or a charger integrates with third-party services (for example, map services, payment gateways, or a charger manufacturer’s cloud system), Zyyver is not liable for the acts or omissions of those third parties. This includes any downtime or errors originating from those external systems. Your use of any third-party feature may be subject to their terms. Zyyver likewise isn’t responsible for content on any external websites linked from our platform.

Payments processed through the Zyyver app are securely handled by Stripe. Users agree to Stripe’s terms and acknowledge that Zyyver does not directly process or store your payment information.

Communication Preferences:

  • Notifications: By installing the Zyyver app, you consent to receive push notifications. You can manage or opt out of these notifications through your device settings.
  • User Accounts: Users choosing to transact via Guest Checkout acknowledge limited account functionalities, including restricted booking history access and limited dispute resolution options. Full registration is recommended for enhanced support.

User Obligationsds

  • Device Permissions: To provide full functionality, Zyyver app requests device permissions including location, Bluetooth, camera, and storage. Users can manage or revoke these permissions in device settings. Disabling certain permissions may limit app functionality.

User Account Terms:

  • Biometric Login & Two-Factor Authentication: Zyyver offers biometric authentication and two-factor login methods for enhanced security. Usage of biometric data (fingerprint or facial recognition) is managed by your device and not stored or accessible by Zyyver.

Data Protection and Privacy

  • Crash/Error Logging & Analytics We collect anonymized crash reports, analytics, and error logs to improve app stability and user experience. No personal information beyond necessary app diagnostics is collected through these processes.

Complaints and Disputes: If a dispute arises between Host and Driver, we encourage you to first communicate directly and amicably resolve it. In the event you cannot reach resolution, you may contact Zyyver support for guidance. Zyyver is not obligated to arbitrate or resolve disputes between users, as the contract is between Host and Driver. However, at our discretion and without prejudice, we may attempt to help mediate or propose a resolution in the interest of customer satisfaction. Any involvement by Zyyver does not mean we assume liability; we might, for instance, facilitate a refund or compensation in certain cases without admitting any fault. These efforts are case-by-case and not a contractual duty. Ultimately, serious disputes (e.g. significant property damage claims) may need to be resolved by the parties’ insurers or through legal action in the courts. Zyyver’s platform is not a substitute for legal process, and by using it you agree that Zyyver’s decision on any platform-related dispute resolution (such as a refund) is final for the purposes of your relationship with us, but does not waive your right to pursue remedies against the other party in the dispute (Host or Driver) outside the platform.

No Third-Party Rights: These policies do not create any rights for anyone who is not a user of Zyyver (no third-party beneficiary rights), except that Zyyver’s affiliates and subsidiaries (and each of Zyyver’s and their officers, directors, employees) can enforce disclaimers and liability limitations for their benefit. Apart from that, only you and Zyyver (and the counterparty user to your Host/Driver agreement) have rights under these Terms. The UK Contracts (Rights of Third Parties) Act 1999 shall not apply except as expressly stated.

Disputes arising from mobile app transactions may initially be raised via the in-app rating and reporting system. Zyyver facilitates automated refunds or resolutions where applicable, though final liability remains between Host and Driver.

Liability and Indemnification

Zyyver’s Liability to Users: Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under UK law. In particular, Zyyver does not exclude liability for: (a) death or personal injury, directly attributable or proved, by our negligence or the negligence of our employees or agents; (b) fraud or fraudulent misrepresentation resulting in direct and actual loss; or (c) any other liability that cannot be excluded by law (such as certain statutory consumer rights). However, beyond these core liabilities, Zyyver’s overall liability to you is limited as described below.

  • Liability Cap: If Zyyver is found liable to you for any claim arising out of your use of the platform or services, our liability will be limited to the greater of: (i) the total fees (commission/service fees) you paid to Zyyver in the 3 months prior to the event giving rise to the liability, or (ii) £100. (For example, if you are a Driver and you paid £5 in Zyyver service fees for a session that led to a dispute, our maximum liability might be £100 as that exceeds the fees. This cap applies to all types of claims in aggregate, to the fullest extent permitted.
  • Zyyver is not responsible for any damage, loss, or theft incurred during transactions booked via the mobile application. Users should maintain appropriate insurance cover. All liabilities remain between Hosts and Drivers as per our general terms.
  • Exclusion of Certain Damages: Zyyver will not be liable for any indirect, consequential, or special losses and will not be liable for business-related losses suffered by any user. This means we are not responsible for: loss of profits or anticipated savings, loss of income or revenue, loss of business or opportunity, loss of goodwill or reputation, loss of data, or any punitive or exemplary damages. For instance, if you are a Host and an outage on our platform prevents a booking and you lose potential earnings, or if you’re a Driver who misses an appointment because a charger booking fell through – Zyyver isn’t liable for those economic losses. We also are not liable for any loss that was not foreseeable to both you and us at the time of your agreement to these terms. (A loss is “not foreseeable” if it was not an obvious consequence of our breach, or if neither party expected it.)
  • No Liability for User Actions or Property Conditions: Because Hosts and Drivers are independent parties, Zyyver is not liable for what happens at the charging location beyond our control. We do not accept liability for damage or injury that arises from the condition of the Host’s property or charger, or the Driver’s vehicle or conduct, except to the extent it results from Zyyver’s own negligence. In other words, if a charger malfunctions or a property defect causes harm, that’s for Host and Driver (or their insurers) to sort out – Zyyver is not responsible for ensuring the safety of physical premises.
  • Use of the Zyyver mobile application may incur mobile data charges from your network provider. Zyyver is not responsible for these charges, and users are advised to monitor data usage.
  • No Warranty for Platform Performance: Zyyver disclaims any warranty that the platform will be error-free or meet all user expectations. While we will exercise reasonable care and skill in providing the service, we make no guarantee of continuous availability or absolute security. Any digital services we provide are subject to the limitations of technology; if our app or integrations cause any damage to your device or data, our liability is limited to repairing the damage or paying compensation up to the cap above, and even that is conditional on you having used the latest version of our app and followed our instructions (similar to Co Charger’s stance on digital content damage). We are not liable for damage you could have avoided by following our advice or using minimum system requirements. Always keep backups of important data as a precaution.

User Indemnification of Zyyver: You agree to indemnify, hold harmless and defend Zyyver (and our directors, employees, and agents) from any claims, liabilities, damages, and expenses (including reasonable legal fees) that arise out of your breach of these Terms or your improper use of the platform. This includes but not limited to, for example, claims arising from:

  • Property Damage or Injury Claims: If you are a Host and a driver or third party sues Zyyver for an injury on your property (arguing Zyyver is responsible as the facilitator), or if you are a Driver and you damage someone’s property and they include Zyyver in a claim, you will cover Zyyver’s costs and damages. (Hosts and Drivers are effectively taking on the risk of their own premises/vehicles, which is why insurance and careful practices are important.)
  • Your Violation of Law or Rights: If your actions (e.g. illegally running a charging business without permission, or a data breach because you mishandled someone’s info) result in a regulatory fine or lawsuit against Zyyver, or if you infringe someone’s rights (like intellectual property or privacy) using our platform, you must indemnify Zyyver.
  • Misrepresentation or False Information: If you provided false information (for instance, lying about having permission to install a charger or about the safety of your charger) and that leads to a dispute or litigation involving Zyyver, you are responsible for the fallout. For example, if a Host misrepresents their charger as compatible with certain vehicles and a Driver’s car is damaged, and Zyyver faces a claim, the Host must indemnify us. Similarly, if a Driver misuses a charger and lies about the circumstances, causing us to incur investigation costs or claims, they must indemnify us.

Zyyver will reasonably cooperate in your defense of a claim and will notify you promptly of any claim. You shall not settle any claim involving Zyyver without our prior written consent (which will not be unreasonably withheld). Zyyver reserves the right, at our discretion, to assume defense of any matter subject to indemnification at your expense, in which case you will cooperate with us.

Acknowledgment of Risk Allocation: By using Zyyver, both Hosts and Drivers acknowledge that the allocation of responsibilities, liabilities, and obligations in these Terms is reasonable. The fees we charge (if any) are modest relative to the potential risks of peer-to-peer charging, and users’ own insurance and precautions are expected to play the primary role in risk management. These liability limitations and indemnities are standard for platforms of this kind, and are in place to allow the service to function without Zyyver needing to charge prohibitive rates or vet every transaction. If you disagree with this risk allocation, please do not use the platform. (Your statutory rights are not affected – for example, if Zyyver provides a service without reasonable care and skill, you may have remedies under the Consumer Rights Act 2015 notwithstanding these Terms.)

Insurance and User Responsibilities

While Zyyver facilitates a community service, all users remain responsible for managing their own risk through insurance and prudent behavior. We strongly urge both Hosts and EV drivers to carry appropriate insurance coverage and adhere to the following guidelines:

  • Host Insurance: Hosts must ensure they have insurance for hosting EV charging. At minimum, verify that your property insurance or homeowner’s insurance covers third-party liability (if someone is injured on your property) and property damage (for the charger and your property) arising from offering charging to guests. Some insurers may consider charger-sharing a “commercial activity,” so disclose this to avoid coverage issues. If needed, obtain a rider or separate liability policy. Remember, owning/operating a charger can present risks (fire, electrocution, etc.) and you may need comprehensive coverage – including liability if a user is injured or their car is damaged, as well as coverage for vandalism or theft of your equipment. Hosts are solely responsible for any uninsured losses; Zyyver will not compensate you for damage to your charger or property (that should be through the driver who caused it or your insurance).
  • Driver Insurance: Drivers must have valid motor insurance as required by law, which generally includes third-party liability coverage for property damage or injury you might cause while driving. Ensure your policy would respond if, for example, you accidentally damage someone’s property (like hitting a wall or the charger) or injure someone on private property – many auto policies extend to liabilities in these contexts, but check. Your comprehensive cover (if you have it) may cover damage to your own vehicle if it’s damaged while parked/charging, but you should confirm whether charging at third-party premises is within coverage. Zyyver does not provide insurance for your vehicle; any damage to your car during a session (e.g. charger electrical fault frying electronics) would typically fall under your own auto insurance or a claim against the Host’s liability insurance. Be mindful of your vehicle warranty as well – using approved chargers and following proper procedures helps avoid warranty issues or insurance denials.
  • User Responsibilities – Safety & Compliance: Both Hosts and Drivers share responsibility for safety. Hosts should regularly inspect their charging equipment and address any maintenance issues. Drivers should inspect the setup on arrival – if you notice anything unsafe (e.g. damage to the charger or cable), do not proceed. Both parties should exercise common sense precautions: Hosts, ensure your charger has no known defects and is used within its rated capacity; Drivers, use the charger only as intended and do not attempt “workarounds” or risky modifications. Follow all instructions – many smart chargers have LED indicators or app controls; understand them before use. If either party is unsure, ask questions (Zyyver can relay messages, or refer to manufacturer’s guidelines). Under no circumstances should anyone attempt repairs or opening of electrical panels during a session – leave that to qualified technicians after the fact.
  • App Update and Version Control: Users agree to periodically update the Zyyver app to the latest version available via the respective app stores. Continued use of outdated versions may lead to limited functionality or loss of service
  • Compliance with Laws and Regulations: All users must comply with applicable laws while using Zyyver. Hosts, this includes any local regulations on running at-home businesses or offering services (some councils might have rules on commercial use of home electricity – ensure you comply). It’s also your duty to ensure the electrical installation for your charger is code-compliant and performed by a certified electrician. Drivers, obey traffic laws and parking rules when approaching or at the Host site (no blocking sidewalks or driveways, etc.). Also, environmental responsibilities: avoid unnecessary idling at someone’s property and dispose of any waste properly. If any incidents occur (fire, electric shock, etc.), relevant laws require reporting to authorities – make sure that’s done (Hosts might need to report electrical incidents under health and safety laws).
  • Mutual Respect and Courtesy: Zyyver fosters a community based on trust. Treat each other with respect. Hosts should not engage in discriminatory behavior (we follow the Equality Act – you cannot reject guests on bases like race, religion, etc., and you should provide reasonable accommodations for disabilities when possible). Drivers should respect the Host’s property (don’t litter, don’t use their garden as a toilet, etc.). Both should respect privacy – any personal information exchanged or observed (like security camera footage, Wi-Fi info, etc.) should be kept confidential and used only for the purposes of the charging arrangement.
  • Incident Reporting and Cooperation: If something does go wrong – such as property damage, theft, or personal injury – both sides should cooperate in good faith. Document the scene (photos of any damage, etc.), exchange necessary information (much like exchanging insurance details after a car accident), and notify Zyyver. Timely reporting (within 24-48 hours) is critical. Zyyver may facilitate communication and evidence exchange. We expect users to work through their insurance where appropriate. For example, if a Host’s charger is damaged, the Host might file a claim with their insurer and the insurer may subrogate against the Driver’s insurer; both users should provide statements or reports as needed. Failure to report incidents promptly or attempts to conceal information will be viewed as a breach of these Terms and could affect your standing on the platform.
  • Apple and Google are not parties to your agreement with Zyyver, and they have no responsibility or liability for the Zyyver mobile app’s functionality, content, or user agreements.

By adhering to these insurance and responsibility guidelines, you not only protect yourself but contribute to a trustworthy community. Zyyver’s policies are designed to mirror industry best practices – for instance, requiring each party to hold insurance and to behave safely – so that peer-to-peer EV charging can be convenient yet secure and well-managed for everyone involved. Governing Law and Jurisdiction: These Terms and any disputes arising under them are governed by the laws of England and Wales. By using the platform, you agree that any dispute that cannot be resolved amicably will be brought in the courts of England and Wales (or, if you reside elsewhere in the UK, you may also pursue claims in your local UK jurisdiction’s courts). Consumers in the UK have mandatory rights, and these Terms operate in compliance with those rights. These Terms do not affect your statutory rights. If any provision is found unlawful or unenforceable, it shall be severed to the minimum extent necessary, and the rest of the Terms will continue in effect. No waiver of any breach of the Terms by Zyyver shall be considered a waiver of any later breach. These Terms constitute the entire agreement between you and Zyyver regarding the platform services, superseding any prior understandings. You indicate your agreement to these Terms by using the platform, and you understand that they are legally binding and intended to be comprehensive and protective of all parties, particularly Zyyver as the facilitator. Please read them carefully and reach out to Zyyver’s support or your legal advisor if you have any questions or concerns before proceeding to use the service.

By enforcing these terms, Zyyver maintains a professional and protective legal posture, ensuring that while we actively facilitate EV charging (including hardware control), we do so without unjustly taking on risks that are better managed by individual insurance or personal responsibility. Users can thus enjoy the convenience of the platform with clarity on their rights and obligations, and with the assurance that these policies have been crafted for the UK context (e.g. compliance with UK laws on unfair contract terms and consumer rights) and will be vetted by our legal team for soundness.
